Financial Services Matters

Defended with excellent results Investment Firms, Insurance Companies, Audit Firms and individuals in Federal Court and before the Securities and Exchange Commission, Massachusetts Securities Department, Department of Labor, Commodities Futures Trading Commission, the Financial Industry Regulatory Authority involving issues under the securities laws including the Investment Advisers Act of 1940, the Investment Company Act of 1940, the Securities Act of 1933, the Securities and Exchange Act of 1944, and the Employee Retirement Income Security Act.

Employment Matters

Successfully defended business clients in Federal and State jury trials against claims of discrimination and wrongful termination, and in multiple actions brought by employees before the Massachusetts Commission Against Discrimination.

Conducted numerous internal investigations into allegations of employee misconduct, harassment, and discrimination.

Advised business on all aspects of Employment Law and Human Resources issues including, regulatory compliance, benefit plans, compensation plans, equity plans, performance review process, employee departures, accommodations, employment offers and contracts.

Insurance Matters

Analyzed and pursued claims with insurance companies to ensure maximum recovery on Director and Officer, Errors and Omissions, Cyber Security, Property and Casualty, General Liability and Fiduciary policies. Successfully brought legal actions against insurance companies to obtain maximum recovery. Defended Insurance companies in Federal Class Actions alleging improper sales practices.

Investigations

Conducted numerous internal investigations on behalf of clients into possible securities law violations, regulatory violations, other violations of law, employee misconduct, allegations of harassment, discrimination and improper termination. Developed and implemented strategy to minimize risk and adverse consequences of negative results of an investigation.
